Combating International Crimes By The Iraqi National Judiciary
Abstract
One of the considerations of state sovereignty, and perhaps one of the most important of these effects, is the sovereignty and authority of the judiciary over crimes committed on the territory of that state, whether those crimes are national or international. What distinguishes the state judiciary and is referred to as fair and developed is if that judiciary has a role in dealing with international crimes and prosecuting the perpetrators of those crimes with impartiality and justice. This is what distinguished the Iraqi judiciary after 2003, as the Iraqi judiciary played a prominent role in combating international crimes. The Iraqi judiciary confronted these crimes, and the decisions of the Iraqi judiciary were based on the foundations of justice and its spirit. These decisions were characterized by neutrality and were in accordance with international standards and guarantees. Specialized courts were established in this field, which dealt with the crimes of the former regime, which are considered crimes against humanity, war crimes, and crimes of genocide. The Iraqi courts also dealt with the crimes committed by the terrorist organization ISIS and considered them international crimes. This is according to what was stated in the report of international experts affiliated with the United Nations, which considered the crimes of the ISIS organization crimes against humanity, war crimes, and crimes of genocide.
